The Inter-American Commission on Human Rights (IACHR) has recommended to the United States that to be in compliance with human rights standards that we must “ensure that no child is subjected to the adult criminal justice system . . .”
We advocate for states to eliminate or limit the application of juvenile transfer laws as much as possible.
At a minimum, states should prohibit the transfer of children under 14 years of age into the adult system and consider increasing the minimum age for transfer eligibility to at least 16 years of age as some states have already done.
